A PLEBISCITE on the creation of a new province in the Davao region will push through as the Supreme Court (SC) dismissed a petition asking it to stop the referendum.

SC spokesperson Theodore O. Te said in a press briefing that the high court dismissed the petition for prohibition filed by former Davao del Sur Representative Marc Douglas C. Cagas IV.

Mr. Te said details on the dismissal were not yet available as of press time.

The plebiscite will be held on Oct. 28, coinciding with the nationwide barangay elections.

Under Republic Act 10360 or the Charter of the Province of Davao Occidental, the new province would be created from municipalities of the present Davao del Sur. It would include Sta. Maria, Malita, Don Marcelino, Jose Abad Santos and Sarangani.

The plebiscite will cover the entire Davao del Sur province, except Davao City.
