3 police officers sued for murder

Police Officer 2 (PO2) Werner Marcojos and PO2 Roel Margallo, both members of the San Isidro Municipal Police Station, were charged with two counts of murder, grave threat, and violation of the domicile under the Revised Penal Code.
San Isidro Municipal Police Station chief Capili was also charged with murder for his alleged involvement in the incident.
The three police officers were brought to Prosecutor Neil Podpod on Friday for inquest proceedings.
PRO-Davao spokesperson Chief Inspector Jed Clamor, in a phone interview with Sun.Star Davao on Thursday, said the three police officers will also be charged with administrative cases like grave misconduct.
"The PRO Regional Investigation and Detective Management Division (RIDMD) is already preparing the administrative charges. Most probably, the administrative charges will be filed against them this week," Clamor said.
Police identified the two victims as brothers Jeffer and Ruben Pingkian.
The accused earlier claimed that the brothers were involved in illegal drug proliferation in Davao Oriental. They were killed after the two allegedly tried to fight the arresting police officers.
According to police reports, the two policemen were monitoring the brothers' “involvement” in illegal drug trade when the brothers shot them.
Jeffer, however, was killed on a shoot-out-chase in Barangay Cuabo, San Isidro on Sunday, while Ruben was later arrested and killed inside the police station on Monday, after he allegedly tried to grab the gun of a policeman.
PRO-Davao Director Wency Pascual said, though, he was not convinced with the report of the San Isidro Municipal Police Station, thus, he ordered the Criminal Investigation and Detection Group (CIDG)-Davao to investigate the incident.
Pascual said the unified investigation showed that PO2 Marcojos and PO2 Margallo had acted beyond the limitation of their function against the Pingkian brothers who were earlier tagged as drug peddlers.
The combined investigation of the Provincial Investigation and Detective Management Section, Davao Oriental Police Provincial Office (Doppo), PRO-RIDMD and CIDG-Davao pointed to the falseness of the earlier report of the San Isidro police about the death of the Pingkian brothers.
According to a PRO-Davao report, however, brothers Jeffer and Ruben were playing heads-or-tail game locally known as "hantak" when they had an altercation with Marcojos and Margallo.
Relatives of the Pingkian brothers said the heated argument resulted in the shooting of Jeffer in Barangay Cuabo by Margallo.
Ruben was able to escape but later gave himself up to a barangay official, who in turn endorsed him to the police Sunday evening.
On Monday morning, Ruben was killed inside the San Isidro Police station. Police claimed that Ruben tried to grab the firearm of a policeman. Ruben was allegedly still handcuffed when killed.
Thus, the three officers who were pointed as the ones responsible for the incident were relieved from the station.
Also relieved from the station were 13 personnel who were on duty during the incident. The 16 policemen are currently at the Regional Personnel Holding and Accounting Unit for investigation.
Pascual said their office is impartial to all people who violate the law, whether the violator is a civilian or an official, or men in uniform.
He added that there will be no whitewash on this case and that those found to be at fault will have to face the consequences.
